Booking conditions of Vero Tours S.A.R.L.

Please read these Terms & Conditions carefully. They contain important information about your holiday contract.

 

1.    Booking

Your contract is with Vero Tours S.A.R.L., Rue 768 porte 503, Baco Djikoroni ACI, Bamako, Mali, referred to as “Vero Tours” in these conditions.When making a booking the client is offering a binding agreement of a travel contract to Vero Tours as his/her tour operator.To make a booking the client can contact us by e-mail. We only accept bookings in writing. The basis for the booking is the trip description on our website if the client books one of our standard tours or individual information, conditions or descriptions stated in writing if the client books a tailormade tour. With his/her booking the client agrees to accept the booking conditions stated below. A booking is accepted and becomes definite only from the date when the Company sends a confirmation invoice to the client who makes the booking. It is at this point that a contract between Vero Tours and the client comes into existence. If the content of the confirmation notice differs from the content of the booking request, the client has the right to cancel the booking within 10 days. The booking becomes only definite if the client confirms the differing content of the confirmation invoice within this delay.

 

2.    Payment for your tour

For all holidays the client will need to pay a deposit of at least 20% of his/her selected travel arrangements. The balance is due 30 days prior to departure If the booking is made less than 30 days before departure, the full amount is due on receipt of the confirmation invoice. If any balance remains unpaid, travel documentation will not be issued and we reserve the right to treat your booking as cancelled and apply the cancellation charge set out below. Please note that Vero Tours does not accept credit cards. The payment for any extra services such as optional tours or activities not included in the trip description must be made directly to the suppliers of these services.

 

3.    Services included in the contract

The extend of the services provided within the contract is defined primarily by the service descriptions set out on the website of Vero Tours and/or by special conditions agreed with the client in writing before the booking and stated in the confirmation invoice. These descriptions and conditions are binding. However Vero Tours reserves the right to make changes of individual services due to unforeseen circumstances if they are of minor significance and do not impair the overall nature of the holiday booked. Such circumstances may include, but are not limited to events that endanger the client’s safety or adverse weather conditions which prevent proper execution of the trip. In such case Vero Tours will provide compensatory services of equivalent value. We commit ourselves to notify the client immediately about any changes that occur. Single rooms cannot be guaranteed everywhere. If a single room is not available a prorated refund of the single room supplement paid in advance will be made.  No refund will be made for any unused services which are included in the price.

 

4.    Price changes

Vero Tours reserves the right to change any of our prices in limited circumstances to reflect increases in transportation costs including fuel and exchange rate variation However, there will be no change within 35 days of your departure. If the surcharge would increase the cost of your holiday by 5% or more, the client may cancel his/her holiday and receive a full refund. Any claims must be made by the client in writing immediately after being notified about the price changes.

 

5.    Cancellation by the client

All cancellations must be made in writing by the person who made the booking and are effective on the day Vero Tours receives it. As we incur substantial costs and losses on a cancellation, we will apply the following cancellation charges:

Up to 43 days before departure: forfeit deposit

42 – 29 days before departure: 30%

28 – 15 days before departure: 45%

14 – 8 days before departure: 60%

7 – 3 days before departure: 75%

Less than 3 days before departure: 90%

If the client is prevented from proceeding with his holiday, he is entitled to transfer his booking to another person deemed acceptable to Vero Tours. In such a case the client and the transferee shall be jointly and severally liable for all monies due to Vero Tours including all charges and reasonable fees consequent upon such a transfer.

 

6.    If Vero Tours cancels a tour

Whilst Vero Tours hopes we will not have to cancel your holiday this does occasionally happen and we reserve the right to do so e.g if any tour does not have the minimum number of participants required to make it commercially viable. We will notify you of cancellation for this reason not less than 4 weeks before the start of your tour. In this case we will provide a full and prompt refund. Other refunds or compensation will not be paid. Vero Tours will not meet any cancellation fees for air or train tickets or cost for visa, vaccination or similar costs in the event of any change or cancellation by us.

Vero Tours reserves the right to terminate a client’s  travel arrangements without any liability on our part ifthe client commits any illegal act when on the holiday or if in the reasonable opinion of the tour leader his/her behaviour is disruptive, threatening or abusive or is causing or likely to cause danger, distress or annoyance to others. In any of these circumstances no refunds or compensation will be paid to the client and Vero Tours may make a claim against him/her for any costs and expenses incurred as a result of his/her behaviour.

 

7.    Cancellation due to force majeure

Compensation will not be payable in any cases where an amendment, change or cancellation is due to ‘force majeure’, being unusual or unforeseeable events or circumstances beyond our or our suppliers’ control, These include, but are not limited to, war, threat of war, riot, civil disturbance or strife, terrorist activity (actual or threatened), industrial disputes, technical or maintenance problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions, levels of water in rivers, acts of God, closure of airports, changes of schedules or operational decisions of transport providers. In any of these circumstances Vero Tours reserves the right to claim compensation from the client to recover costs on services already paid to our suppliers.

 

8.    Responsibilities

Vero Tours takes care to ensure that all involved in the preparation and supply of your holiday maintain the highest standards. Please note that standards of, for example, safety, hygiene and quality vary throughout the destinations that your holiday may involve and may be not the same as developed international standards. Clients bookings are accepted on the understanding that they appreciate the possible risks inherent in adventure travel and that they undertake the tours, treks or expeditions featured in our at their own volition.

If the product supplied to the client is not of the standard described or contracted for by him/her, the client must inform Vero Tours or our representatives on the tour as soon as possible to give us the maximum opportunity to rectify it. Vero Tours can rectify it by suitable alternative arrangements made for the client at no extra cost. Vero Tours may refuse to provide remedies if to do so would involve unreasonable costs. If the client fails from reporting the deficiencies, he/she is not entitled to a reduction of the travel price. Any unresolved complaints must be notified to us in writing within 30 days of your return.

Vero Tours is not responsible for any services not included in our prices (e.g optional excursions and activities or flights). Flights are no included in our service package and it is the client’s responsibility to arrange the flight to/from the destination of his/her holidays. Any expenses related to late arrival or departure, lost or damaged baggage must be paid by the client. Our group packages include one airport transfer on arrival and one on departure of the group. If a client arrives late he/she is responsible for any extra costs for the transportation which may occur to join the group.

The client agrees to comply with local laws and regulations, and to respect cultural practices observed during the tour.

In the chapter “Practical information“ on our website Vero Tours provides health information and a list of travel clinics where the client can obtain further information about risks and medical prevention. These are only guidelines. It is the client‘s responsibility to ensure that he/she obtains proper and detailed medical advice. The client must be healthy, fit, and prepared to endure hot weather conditions. The participation in game-drives or walks, hiking trips, boat rides, camel or horse riding is at the client’s own risk.

 

 

9.    Passports, visas and vaccinations

It is the client’s responsibility to ensure that he/she is in possession of a valid, acceptable passport and any visas and vaccination certificates required for the whole of the journey. Failure to do so may incur amendment charges which are your responsibility. All information about these matters given by Vero Tours is given in good faith but without responsibility on the part of Vero Tours. We regret we cannot accept any liability if you are refused entry into any country due to failure on your part to carry all required documentation. In this case Vero Tours will apply the cancellation charges stated above. Please note that visa fees are not included in our prices.

 

 

10.  Insurances

For your own safety we recommend you to have adequate travel insurance to provide accident and medical cover. The client should ensure that he/she has sufficient pre-departure cancellation cover, a travel liability and a baggage insurance. It is the client’s responsibility to ensure he/she has adequate insurance cover.

 

11.  Jurisdiction

Regardless of the place of execution, performance or domicile of the parties, this contract,
together with all modifications and amendments, shall be governed by, construed under and in
accordance with, the laws of Mali. It is specifically agreed that in the event of any legal or equitable action be initiated, the exclusive venue of such action shall be solely in the city of Bamako, Mali

 

12. Website and advertising material accuracy

     The information contained on our website and in our other advertising material is believed correct to the best of our knowledge at the time of publication. However, errors may occasionally occur and information may subsequently change. You must therefore ensure you check all details of your chosen tour (including the price) with us at the time of booking.
